Constitution of the Swiss National Bureau of Insurance (NBI)

The insurance undertakings active in the motor third party liability insurance branch constitue and administrate together the National Bureau of Insurance, which has its own legal personality (art. 74 par. 1 of the Road Traffic Act SVG).

Art. 1 par. 1 of the constitution of the NBI states that the NBI is established as an association according to art. 60 ff of the Swiss Civil Code (ZGB).

According to art. 60 par. 2 ZGB, the constitution has to be issued in written form and contain the provisions concerning the purpose, the financing and the organisation of the association. Art. 55 par. 1 of the Legal Ordinance on vehicle insurance (VVV) states that the constitution of the NBI has to be approved by the supervisory authorithy, the Federal Roads Office (FEDRO).
